US Judge Mandates Release of Abrego Garcia from Immigration Custody

Legal proceedings

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. After his return to the United States to face human smuggling charges, he was detained in federal detention.

In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The court challenge involve disputed claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

Conditions of Release

The judge, who was hearing his petition to removal in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.

This ruling represents a significant development in a complex legal case involving claims of mistaken imprisonment and contested criminal associations.
